Terms of Service

By accessing or using Off Com ("the Platform," "we," "us," or "our") at offcom.io or any associated mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use this platform. These Terms apply to all visitors, registered users, builders, vendors, and any third party that accesses the Platform in any capacity.

All content on Off Com — including but not limited to Build Plate data, the OC Build Plate ID system, the Starship Score appraisal methodology, community reputation algorithms, design assets, logos, written content, and software — is the exclusive intellectual property of Off Com and its licensors. The "Off Com" name, wordmark, and logo are trademarks of Off Com. Unauthorized use of any Off Com trademark, trade dress, or branding is strictly prohibited.

User-submitted content (build photos, stories, modification logs) remains owned by the submitting user. By submitting content, you grant Off Com a worldwide, royalty-free, non-exclusive license to display, distribute, and promote that content within the Platform.

This is non-negotiable.

You may NOT, under any circumstances:

• Use bots, spiders, crawlers, scrapers, automated scripts, or any other automated means to access, collect, extract, or copy data from the Platform — including Build Plates, user profiles, modification logs, appraisal values, or feed content.

• Bulk download, mirror, or reproduce Off Com data or content in any form.

• Use headless browsers, browser automation tools (including but not limited to Puppeteer, Playwright, Selenium), or API clients to programmatically extract Platform data without explicit written permission from Off Com.

• Attempt to reverse engineer, decompile, or derive the source code, algorithms, or data structures underlying the Platform.

• Use any data obtained from Off Com to train machine learning models, build competing products, or populate third-party databases without written consent.

Violation of this section constitutes a breach of these Terms and may result in immediate account termination, IP blocking, and civil legal action under the Computer Fraud and Abuse Act (CFAA), the Digital Millennium Copyright Act (DMCA), and applicable state and international law. We actively watermark and fingerprint all data responses. Misuse is traceable.

Access to Off Com data via any programmatic means is subject to rate limits enforced server-side. Repeated requests that exceed reasonable limits will be automatically blocked. Circumventing rate limiting through IP rotation, distributed requests, or other technical means is prohibited and constitutes unauthorized access.

You agree not to:

• Post false, misleading, or defamatory content about builds, builders, vendors, or community members. • Impersonate any person or entity, or misrepresent your affiliation. • Use the Platform for any unlawful purpose or in violation of any applicable regulation. • Attempt to gain unauthorized access to any account, server, or network connected to the Platform. • Interfere with or disrupt the Platform's integrity or performance. • Use the Platform to send unsolicited messages (spam) to other users.

Off Com reserves the right to remove content and suspend or terminate accounts for violations of this section without notice.

Off Com provides a marketplace for members to list and purchase builds and parts. All transactions are processed through Stripe. Off Com charges a 7% platform fee on completed transactions.

Off Com is not a party to transactions between buyers and sellers. We do not guarantee the accuracy of listings, the condition of items sold, or the performance of either party. Users transact at their own risk. Build history and appraisal data is provided for informational purposes and does not constitute a warranty of value or condition.

All sales are final unless otherwise agreed in writing between buyer and seller. Off Com may, at its sole discretion, assist in dispute resolution but is not obligated to do so.

Off Com collects user account information, build data, and usage analytics to operate and improve the Platform. We do not sell personal data to third parties. Build Plate data that is set to "Public" is visible to all users and may be indexed by search engines.

By using the Platform, you consent to the collection and use of your data as described herein. For questions about your data, contact us at privacy@offcom.io.

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. Off Com makes no warranty that the Platform will be uninterrupted, error-free, or that appraisal values will reflect actual market outcomes.

To the maximum extent permitted by law, Off Com shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of data, revenue, or goodwill.

Off Com's total liability to you for any claim arising out of or relating to these Terms shall not exceed the amount you paid to Off Com in the twelve months preceding the claim.

Off Com reserves the right to suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform immediately ceases. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property rights, prohibitions on scraping, disclaimers, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.

Off Com may update these Terms at any time. We will notify registered users of material changes via email or in-app notification. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. The current version will always be available at offcom.io/terms.
